Louisiana. Parish Court (Orleans Parish)
Change of Domicile Declarations, ca. 1831-1852 (bulk, 1832-1840)
1 carton (0.3 ft.)
Article 42 of the Civil Code of the State of Louisiana (1825) reads, in part, "The domicil [sic] of each citizen is in the parish wherein his principal establishment is selected. The principal establishment is that in which he makes his habitual residence. . . ." A change of domicile occurs, according to Articles 43 and 44, "by the act of residing in another parish, combined with the intention of making one's principal establishment there. . . . This intention is proved by an express declaration of it before the judge of the parishes, from which and to which he shall intend to remove. This declaration is made in writing, is signed by the party making it, and registered by the judge."
The records comprise 146 manuscript declarations of intention to change domicile as prescribed by the above-noted laws. In most cases the documents identify the place of previous domicile as well as the intended domicile. Most involve intrastate movements, but several identify individuals coming to Louisiana from other states. A handful of individuals made more than one declaration. For a sample, see slave trader Isaac Franklin's 1832 declaration.
The list below, arranged in chronological order, gives names, dates of declarations, old and new domiciles, notes, and file location. The notes record additional information (e.g., age, place of origin, occupation, length of residence, etc.) contained in individual declarations. The file location indicates the folder and item number (within the folder) of each declaration.
Please note: These records have not been microfilmed or digitized and are available for in-house use only, by appointment. If you wish to consult the records, please contact the Archivist in advance of your visit.
